Biography

Eder has 13 years of professional experience, and is currently a member of the Baker McKenzie's Tax Practice Group. He joined the Firm in 2014. He focuses on tax litigation, administrative, legal protection, tax compliance and consulting, and he has broad experience in the constitutionality of tax laws and taxpayers' defense against the actions of the tax authorities in the exercise of their review and enforcement powers. Eder also supports other practice groups such as International Trade & Commerce.

Eder also advises on compensation and payment of contributions to the Social Security Mexican Institute and the National Workers Housing Fund Institute. He is experienced in the attention of requirements and tax inspections by tax authorities. He also handles dispute resolution matters before administrative authorities and the Mexican Tax Ombudsman, litigation matters before the Federal Court of Tax and Administrative Justice, District Courts and Collegiate Courts.

Before joining Baker McKenzie, between 2009 and 2014, Eder worked as senior attorney in the areas of Tax Litigation and Social Security Controversy for Deloitte, in Ciudad Juarez, Chihuahua.

Practice Focus

Eder focuses his practice on tax and administrative litigation. He has participated in defending taxpayers against unconstitutional tax and administrative laws, as well as against the actions of the tax and administrative authorities in the exercise of their verification powers. In addition, he has participated in multiple tax audits as well as in proceedings with the Mexican Ombudsman.

Eder is knowledgeable about tax controversy, including procedures before and against the Social Security Mexican Institute and the National Workers Housing Fund Institute. He has provided professional services to multinational corporations, consolidated groups, and companies that are part of the manufacturing sector, automotive sector, real state sector, and mining sector, among others.

Representative Legal Matters

  • Supported taxpayers in audits conducted by the tax and administrative authorities in all kind of taxes, as well as in the administrative procedures derived from tax refund requests.

  • Participated in the defense of taxpayers against tax and/or fine assessments as well as the refusal of the tax and administrative authorities to refund them.

  • Participated in the defense of taxpayers against the enforcement of unconstitutional tax and administrative laws.

  • Participated in the representation of taxpayers in the requests of conclusive agreements with the Mexican Ombudsman.

  • Participated in various tax litigations and administrative appeals against the Ministry of Finance and Public Credit, Tax Administration Service, Social Security Mexican Institute and the National Workers Housing Fund Institute.

  • Participated in the development and follow-up of various administrative law proceedings.

  • Provided guidance and advice on the identification and prevention of transactions with suppliers included in the lists published by the Federal Tax Authority pursuant to Articles 69 and 69-B of the Federal Tax Code, in order to demonstrate the substance of the services rendered, obtaining favorable results before the tax authorities, Mexican Ombudsman, Tax Court and Collegiate Circuit Courts.
