Biography

James Ng is a dispute resolution lawyer with over 10 years of experience in international arbitration. He is qualified to practice law in Hong Kong, New York, England and Wales, with Higher Rights of Audience before all English civil courts as a Solicitor Advocate.

James has represented clients on complex and high stakes litigations and arbitrations involving commercial, hospitality, IP, joint venture, M&A, private equity and TMT disputes. He has appeared as advocate, counsel and tribunal secretary in international arbitrations under the CIETAC, HKIAC, ICC, LCIA, SHIAC, SIAC and UNCITRAL Rules subject to a variety of governing laws.

Earlier in his career, James was a Counsel at HKIAC who managed over 300 arbitration cases focusing on China-related disputes. He is uniquely positioned to advise clients on the intricacies of the arbitral process drawing from his private practice and institutional experience.

James is also an arbitrator listed on various panels of arbitrators, and a Fellow of the Chartered Institute of Arbitrators and the Hong Kong Institute of Arbitrators.

Representative Legal Matters

  • Defended a USD 1.4 billion shareholder claim in a joint venture dispute subject to PRC law. Discharged an anti-suit injunction by the Hong Kong courts restraining PRC litigation proceedings and recovered costs for the client.
  • Defending a listed company in an English law governed dispute arising out of two long-term LNG supply contract for a claim exceeding USD 200 million.
  • Defended an application before the Hong Kong courts to set aside a favourable ICC arbitral award in excess of USD 160 million.
  • Obtained an HKIAC arbitral award in excess of USD 50 million in three consolidated arbitrations against the controlling shareholder and two guarantors for a private equity dispute.
  • Secured a favourable settlement and a termination of an HKIAC arbitration, with no adverse costs order, regarding a New York law governed video game development and distribution agreement.
  • Obtained emergency arbitrator relief (including anti-suit injunctions, anti-anti-suit injunctions and anti-enforcement injunctions) for an English law governed HKIAC arbitration regarding licensing rights in the CIS.
  • Defended an opposition to a winding-up petition before the Hong Kong courts based on a USD 30 million cross-claim brought in a parallel Swiss ICC arbitration.
