Practice Focus
Myroslava specializes in IP law, including comprehensive advice on IP enforcement and anti-counterfeiting, IP clearance, IP portfolio management, trademark and patent registration, structuring of sophisticated IP/IT transactions, licensing and franchising.
She particularly focuses on providing strategic advice on IP rights (IPR) protection, patent and trademark searches, global portfolio management, IP-related transactions, structuring and supporting license and/or franchise deals, IPR protection at customs, IP due diligence and alternative conflict resolution (ACR) for matters involving IPR infringement.
Myroslava acts as a strong negotiator at all stages of ACR and IP/IT transactions.
As a registered Patent and Trademark Attorney of Ukraine, Myroslava represents clients before the UAIPO, customs bodies, police and other state bodies and private entities in matters relating to IPR protection and enforcement.
Representative Legal Matters
- Advising a leading multi-category consumer goods company on all aspects of trademark protection in Ukraine. This includes preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to the client's applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against infringing trademark applications and registrations, performing clearance searches, and filing domain name complaints with the WIPO Arbitration and Mediation Center using the Uniform Domain Dispute Resolution Administrative Procedure.
- Running a Ukrainian anti-counterfeiting campaign for the biggest fitness chain in the world against unauthorized and unlicensed use of the client's trademark on open markets of sporting goods and activities by third parties. Successfully negotiated amicable settlements with various businesses, prompting them to stop unauthorized use of the commercial name and trademarks.
- Representing a British multinational oil and gas company before Ukraine Customs in matters related to protection of the company's trademarks at customs. Also assisting in corresponding work, including seizing counterfeit goods at customs and overseeing destruction of seized goods. Also representing the client in managing its trademark and design portfolio in Ukraine, namely filing new applications, renewing IP rights, and advising on recording changes and internal transactions with respect to trademarks and designs.
- Advising an American privately owned multilevel marketing company on all aspects of trademark protection in Ukraine. This includes preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to pending applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against infringing trademark applications and registrations, and performing clearance searches.
- Representing a French multinational holding and conglomerate specializing in luxury goods before Ukraine Customs in relation to border protection of trademark rights and with respect to counterfeit products distributed in Ukraine. Represented the client in conflict resolution negotiations with the owner of a conflicting mark bearing the well-known company's logo. Designed comprehensive strategy to solve the matter with the third party without involving court litigation. Issued a cease-and-desist letter to the third party with detailed demands and successfully negotiated the most favorable solution for the client.
- Provided comprehensive legal advice and designed market entry strategy for a British cosmetics, skincare and perfume company. Structured and managed a complex project that involved investigating the Ukrainian market to detect any use of the client's trademarks, filing a campaign for protecting existing trademark gaps in Ukraine, and enforcing campaign aimed at combating illegal use of the client's trademarks and copyright by unauthorized third parties.
- Represented an American producer of plant-based meat substitutes in a complex trademark assignment from its local distributor. Advised on the applicable procedure and conducted negotiations with the client's distributor. Successfully complied with all the formalities before the UAIPO. It was extremely important to solve the matter amicably and to assign the marks to the client while providing the distributor with the license, without involving enforcement actions. Advising the client on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to pending applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against infringing trademark applications and registrations, and performing clearance searches.
- Advising a French personal care company on all aspects of trademark protection in Ukraine. This includes preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to the client's applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, and filing oppositions against infringing trademark applications and registrations.
- Advising the largest American multinational telecommunications and media conglomerate on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to pending applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against infringing trademark applications and registrations, and performing clearance searches.
- Advising an American multinational confectionery, food, holding, beverage and snack food company on all aspects of trademark protection in Ukraine, including preparing and executing complex trademark filing strategies, responding to provisional refusals issued with respect to pending applications filed in or designating Ukraine, monitoring infringing trademark applications and registrations, filing oppositions against infringing trademark applications and registrations, and performing clearance searches.
