Rafael García Luna
Biography
Rafael García Luna is an associate in Baker McKenzie's Banking and Finance practice group in Mexico. His practice focuses on advising financial institutions on complex regulatory matters. His experience also includes the Mexican public sector, where he worked for several years in the Securities and Savings Banking Unit of the Ministry of Finance and Public Credit.
Practice Focus
Rafael focuses on regulatory compliance aspects of banks, Fintech companies, brokerage firms, SOFIPOS, SOFOMES, financial groups, clearing houses and participants in payment systems. This includes issues related to corporate governance structures, regulatory matters related to AML/CFT (including KYC processes, file integration and sanctions), digital banking, supplier contracting, related persons operations, among others. Additionally, Rafael advises clients in licensing processes (authorizations and registrations) for financial intermediaries, as well as in change of control processes before financial regulators in Mexico.
Rafael's experience includes advising start-ups seeking to innovate the Mexican financial market, digital banks, card payment processors (aggregators and acquirers) and cryptocurrency platforms.

Advising an Argentine financial technology company in the preparation of its application to be an electronic payment funds institution before the CNBV.

Advising a Mexican start-up in connection with the acquisition of all the shares of a popular financial company (SOFIPO), as well as in the launch of its credit product.

Advising a foreign financial institution in connection with the regulatory treatment of subsidiaries in Mexico, derived from an Open Public Offering in Europe.
