There have been various recent developments in relation to the availability of interim protection for parties to a dispute in the Middle East, including its forms and conditions when granted. With the DIFC Court of Appeal changing the approach to jurisdictional gateways in Sandra Holding Ltd, the possibility to use the DIFC Courts for future Middle East disputes may become more limited.
This highlights the importance of the relevant onshore dispute resolution regimes in the UAE, Saudi Arabia and other Middle East jurisdictions where the same relief may not be readily available, as well as in other jurisdictions with approaches similar to those of the DIFC.
