Biography

Roger van de Berg, a partner in the Amsterdam office's Indirect Tax group, specializes in VAT and customs. He is also co-heading Baker McKenzie's EMEA VAT/Customs Sub Practice Group.

Roger has a strong focus and 12+ years of experience on crypto and blockchain technology, assisting exchanges, miners, funds and marketplaces on EU VAT implications and audit readiness. He also assists tech and retail companies on VAT implications of AI technology.

His work further includes advising on European and Dutch VAT aspects of cross-border transactions, M&A, (omni-channel) supply chain restructuring, fiscal representation matters, holding companies and compliance issues.

Roger regularly speaks at conferences on VAT, due diligence and bitcoin/blockchain technology. He also wrote on the EU VAT treatment of bitcoin in various tax magazines as well as formal recommendations to the OECD with respect to the indirect taxation of cryptocurrencies.

Practice Focus

Roger has been involved in several multi-country M&A and restructuring projects between leading companies in tech and retail. He also assisted in major Dutch VAT disclosure and qualification projects for high-tech product manufacturers, data centers and crypto platforms. He has extensive experience working with non-EU based companies who use the Netherlands as their point of entry into Europe and assists these companies with expansion to other EU Member States.
