Biography

Howard Shiu is a partner at Baker McKenzie's Taipei office, where he is well-versed in labor and employment law.

His practice primarily involves advising both domestic and international corporate clients on employment-related matters, including resolving labor disputes, navigating employment issues in mergers and acquisitions, conducting investigation into the employees' alleged misconducts (sexual harassment, workplace bullying, corruption, etc.), negotiating collective bargaining agreements with unions, handling mass redundancies, and ensuring compliance with employment regulations.

In addition, Howard has been praised for his deep understanding of current labor market trends and has been recognized as a Band 1 Lawyer in the Chambers Greater China guide, as well as a Recommended Lawyer by The Legal 500 Asia Pacific.

Resolution of Labor Disputes

  • Represented various multinational financial institutes, high-tech companies, chain restaurants, etc. in handling their private negotiations, mediations and/or lawsuits in labor disputes.
  • Representing various high-profile companies in conducting internal investigations on employees’ suspected misconducts, involving sexual harassment, embezzlement, bribery, and forgery.
  • Represented various high profile clients in closing and obtaining favorable judgments for wrongful termination lawsuits filed by former employees.

Employment Issues in Mergers & Acquisition Transactions

  • Advised on employment issues in M&A transactions for various high-profile MNCs.
  • Advised on employment issues during the post-merger integrations (including transfer of employee welfare funds and consolidation of employee benefits) and various high-profile MNCs.

Negotiating Union Collective Bargaining Agreements

  • Represented high-profile foreign private equity in negotiating and concluding a CBA with the employees union of one important local bank.
  • Represented Standard Chartered Bank in preventing its employees union from initiating strike action and concluding at least two rounds of CBA negotiations with its employees union, while the second round took less than two months, a record in Taiwan’s union history. (Disclosable)

Mass Severance

  • Assisted the liquidator of one high-profile investment back to close its Taiwan subsidiary, laying off most of its employees and transferring the remaining employees to another firm.
  • Assisted one high-profile foreign insurance company in terminating the employment of over half of its more than one thousand employees.

Compliance of Employment Regulations

  • Advising various high-profile retailers, chain restaurants, high-tech companies on their employment law compliance issues, such as overtime, severance, pension, annual leave, female employees, working hours arrangement, and employees privacy.
