Biography
Emma is a special counsel in the Dispute Resolution team of Baker McKenzie’s Sydney office, focusing on competition and consumer law, compliance and investigations.
Practice Focus
Emma practices in commercial disputes with a particular focus on compliance disputes and investigations, including in the areas of competition and consumer law and healthcare / life sciences law.
Emma spent 2018 and 2019 working in Baker McKenzie's London office where she assisted clients with multijurisdictional internal and regulator investigations, anti-competitive conduct disputes and commercial litigation (including competition litigation) in the High Court of England and Wales.
Representative Legal Matters
- Assisting clients to navigate investigations conducted by Australian regulators including the Australian Securities and Investments Commission (ASIC), the Australian Competition and Consumer Commission (ACCC) and the Therapeutic Goods Administration (TGA).
- Assisting clients with enforcement proceedings brought following compliance investigations conducted by Australian regulators.
- Assisting clients in various industries with obtaining merger clearance from the Australian Competition and Consumer Commission, including most recently, an Australian wireless infrastructure company, a global industrial manufacturing company, a global medical device company and a global agricultural science and technology company.
- Advising global consumer goods and retail clients regarding potential claims for anti-competitive conduct and misleading or deceptive conduct, false representations and unfair contract terms under Australian Consumer Law, including claims relating to environmental credentials.
- Acting for global laboratory testing, inspection, certification services company in Supreme Court of NSW proceedings involving breach of contract, negligence and misleading or deceptive conduct claims.
- Assisting a global cosmetics company in private competition litigation regarding vertical restraints resulting from a selective distribution model.
- Acting for global engineering and construction company in multiple concurrent Federal Court proceedings, including a class action proceeding, regarding traffic forecasting for a motorway, involving claims in contract and claims under the Corporations Act 2001 and Trade Practices Act 1974, including misleading or deceptive conduct claims.
