Biography

Joanna Ouyang is a partner at Baker McKenzie's Taipei office. She focuses her practice on dispute resolution, intellectual property, healthcare, privacy, and technology law.

Prior to joining the Firm, Joanna served as a judge at the Taipei and New Taipei District Courts, as well as the Intellectual Property (IP) Court, accumulating extensive experience handling a variety of civil, criminal, commercial, and IP-related cases. She also worked as a research judge at the Judicial Yuan judge (2014-2017), participating in discussions and negotiations on numerous legislative amendments, particularly in the areas of healthcare, antitrust, IP, finance and economics.

Since joining the Firm, Joanna has leveraged her solid legal expertise, substantial litigation experience and strategic planning, argumentation, and negotiations skills to achieve favorable outcomes for her clients.

Additionally, Joanna is a Certified Information Privacy Professional/Europe (CIPP/E), and is knowledgeable in Taiwan's Personal Data Protection Act and the EU's General Data Protection Regulation (GDPR).

Representative Legal Matters

  • Engaged by a renowned international bank to deal with cross-border disputes in the amount of nearly USD 200 million, and achieved a satisfactory settlement for our client.
  • Acted in the appellate court for a world-renowned luxury brand in a distribution dispute, and successfully persuaded the court to reverse the lower court judgment and obtained a judgment fully in favor of our client.
  • Represented an energy company to appeal to the Supreme Court against an unfavorable judgment in the amount of NTD 500 million, persuaded the Supreme Court to reverse and remand the judgment, and achieved a satisfactory settlement for our client.
  • Acted in the appellate court for a world-renowned luxury brand in a trademark parody case, and successfully persuaded the court to reverse the lower court judgment (as well as differ from all previous unfavorable decisions made by authorities in the criminal proceedings), and not only rule in favor of our client, but also unprecedentedly grant our claim to order publication of excerpt of court judgment in up to three newspapers.
  • Represented an electronic component group in handling a long-term, multimillion-dollar cross-border dispute. Successfully revoked the provisional attachment against our client and obtained a non-indictment decision, followed by achieving a satisfactory settlement for our client.
  • Acted in the appellate court for a steel trader, and successfully persuaded the court to reverse the lower court judgment and helped our client retrieve the scammed funds.
  • Acted for a tech company in a trade secret misappropriation case, and successfully persuaded the court to not only grant our motion to perpetuate evidence, but also conduct it in a rare way of "disk mirroring" the laptop of the former employees so as to recover deleted files.
  • Draft or review various agreements for biotech companies, drug companies, medical device companies, cultural and creative companies, and advise on the compliance of health laws and privacy laws.
  • Acted for a Japanese technology company in an antitrust administrative lawsuit regarding concerted actions, and obtained a court ruling fully in favor of our client.
