Biography

Harriet Oldmeadow is partner in the Sydney office of Baker McKenzie and specialises in dispute resolution and risk management in the areas of construction, energy and major projects.

Practice Focus

Harriet has extensive experience across the full range of dispute resolution processes including litigation, expert determination and domestic and international arbitration. Harriet also advised on statutory adjudications across Australia with particular experience in New South Wales and Victoria.

Harriet is a highly proficient and effective negotiator. She works closely with her clients to develop litigation prevention strategies and when litigation proceedings commence in respect of defect claims. She has a strong track record in defending claims of this nature for her clients.

In relation to project delivery, Harriet advised clients on issues that arise at each stage of the project's life cycle. In this regard, she provides advice to clients on how to approach and manage claims.

Representative Legal Matters

Construction Litigation

  • Acting for the most prominent developer of water treatment facilities in Australia in three Supreme Court matters and one successful Federal Court matter over a period of 5 years (this matter is ongoing).
  • Acting for a prominent develop of solar and battery in Australia, in relation to delivery and dispute avoidance on five solar farms and a successful expert determination on a solar farm based in Queensland in relation to interpretation of clause in a Power Purchase Agreement (these matters are ongoing).
  • Acting for a tier one contractor over 10 years specifically in relation to - a successful,7-nil, High Court of Australia judgment in respect of whether a builder owed a duty of care to avoid economic loss; a successful New South Wales Supreme Court judgment in relation to a property known as "Beau Monde";  3 separate Supreme Court of New South Wales and several matters in Victoria involving extension of time; covid related delay; variations and defects (some of these matters are ongoing).
  • Acting for a operator of a hospital in relation to two arbitrations involving a hospital in New South Wales delivered under the PPP (these matters are ongoing).
