Biography

Mag. Mark Nemeth is a junior associate of Baker McKenzie’s Commercial, Data, IPTech & Trade Team in Vienna. Prior to joining the Firm in January 2023, he obtained professional experience as a judicial clerk at the Higher Regional Court Vienna and as a Paralegal in several Viennese law firms. He studied law and Transcultural Communication at the University of Vienna. He gained international experience as an exchange student at the Université Paris II Panthéon-Assas and at the Universidad Complutense de Madrid.

Practice Focus

Mark advises multinational and domestic clients on all aspects of intellectual property, commercial contracting and technology law, with a special focus on technology disputes, online personality rights infringements and platform regulation.

Representative Legal Matters

  • Representing a global technology company in civil proceedings concerning alleged IP and personality rights infringements on its platform.

  • Advising a global technology company on the Digital Services Act.

  • Advising a global technology company on its Austrian product launch, including on consumer protection, e-commerce and advertising law.

  • Representing an energy supplier in mass litigations against 180 customers, including before the Austrian Supreme Court.

  • Advising the European franchisee of a major franchise system on contract negotiations with its franchisor.

  • Advising a major media production company on a movie production.

  • Advising a global IT consultancy company on a major outsourcing deal.
