Practice Focus
Jack focuses his practice on the energy, infrastructure, transportation and finance sectors. His clients include international energy companies, renewables developers, commodity trading firms, midstream operators, EPC contractors, oilfield services companies and banks. He has litigated and arbitrated controversies throughout the United States and internationally.
In the investigative and white-collar sphere, Jack has represented individuals and companies in Foreign Corrupt Practices Act, False Claims Act, Clean Water Act, Seaman Manslaughter Statute, fraud and whistleblower matters.
Finally, Jack advises clients on compliance with US energy regulations, HSE (health, environment and safety) issues, and incident response, a practice he developed while representing Transocean in the Macondo oil spill.
Representative Legal Matters
- Defended a US energy trading business in a USD 100 million breach of contract claim arising from Winter Storm Uri.
- Represented the president of a European oilfield services and engineering firm in relation to Foreign Corrupt Practices Act allegations investigated by the US Attorney's Office for the Southern District of Texas, which resulted in the nonprosecution of the client.
- Won a temporary restraining order for an EPC contractor preventing a counterparty from drawing US 75 million on a standby letter of credit.
- Served as an internal investigation lead and trial team member for an international drilling contractor following the Macondo incident, including preparing the internal report, preparing witnesses to testify before the President's Oil Spill Commission, the US Congress, and the BOEMRE/US Coast Guard Joint Investigation, litigating MDL issues, negotiating Clean Water Act, Oil Pollution Act, and Natural Resource Damage Assessment settlements with the DOJ and EPA, and participating in the Phase 1 and Phase 2 civil trials.
- Advised a new energy infrastructure company with operations in the US and Mexico in conducting a company-wide compliance assessment and overhaul.
- Conducted an internal investigation and represented a company and its former CEO in relation to a commodity price-fixing action by the Attorney General of California, resulting in no claims being made against either client.
- Conducted an investigation of alleged violations of the FCPA and UK Bribery Act in five jurisdictions on behalf of an international energy and natural resources company.
- Represented a Canadian midstream company in conducting an internal investigation into design, engineering, and construction issues in a major interstate pipeline, handling associated safety issues raised by PHMSA, BSSE and state regulators, and bringing an arbitration claim to recover damages.
- Won the dismissal with prejudice of a state- and nation-wide product defect class action brough against a major international energy company in the Eastern District of Tennessee.
- Negotiated a walk-away settlement for an international engineering firm on a claim that it breached its contract and was grossly negligent in developing infrastructure plans, market assessments, and swap agreement analysis in relation to a renewable energy project.
