Biography

Daru Lukiantono is the Head of Intellectual Property & Technology (IPTech) practice group. Daru has been leading the Firm's sizeable IP team with more than 25 years of experience behind him. He advises domestic and international clients on the full range of contentious and non-contentious intellectual property work, covering trademarks, patents, copyrights, industrial designs, trade secrets, layout designs of integrated circuits, and plant varieties.

He has robust skills in handling commercial intellectual property related transactions, including licensing, intellectual property rights, acquisition, franchising and domain names and information technology issues, intellectual property litigation, as well as a number of anti-counterfeiting projects in several major cities in Indonesia. Daru is an intellectual property practitioner who has experience in complex intellectual property due diligence and management cases.  Moreover, he possesses a range of experience in patent prosecution, patent portfolio management, commercial patent work and patent litigation.

Daru received a scholarship from the Association for Overseas Technical Scholarships (AOTS) and the Japanese Institute of Invention and Innovation (JIII) to attend the IP Training Course for Patent Experts (IPPE) in Tokyo, Japan (January-February 2004).

Representative Legal Matters

  • Advising on several intellectual property litigation matters such as cancellation and invalidation actions against third parties’ trademark and industrial designs registrations at the Commercial Court, as well as civil action cases.
  • Registering and extending the protection of their trademarks/service marks including filing oppositions and/or rebuttals on trademark matters at the Trademark Office.
  • Filing appeals against the Trademark Office decisions at the Mark Appeal Commission.
  • Initiating enforcement actions, i.e. anti-counterfeit projects, including cease and desist campaigns against the counterfeiters, filing criminal complaints at the National Police Office and civil servant investigation team of the IP office for raids to be carried out against the counterfeiters/infringers.
  • Coordinating intellectual property investigation and market surveys, on counterfeit activities including advising on the required strategies.
  • Appearing as a witness against counterfeiters, and monitoring the process of Police case files at the Public Prosecutor's Office and the Criminal Court.
  • Filing patents application at the Patent Office, providing legal opinion on patentability and patent infringement issues.
  • Registering copyright work at the Copyright Office and industrial designs at the Industrial Design Office.
  • Providing general legal advice regarding protection of trade secrets, layout of integrated circuits, and plant varieties.
  • Providing general advice on intellectual property (trademarks, copyrights, and patents) asset/portfolio management and protection, as well as intellectual property due diligence relating to merger and acquisition projects.
  • Advising on and drafting general intellectual property agreements including trademark, patent and copyright assignment of rights, as well as licensing agreements and franchising.
  • Advising on relevant legal issues regarding intellectual property in the pharmaceutical industry (labelling, trademark issue on product packaging).
  • Advising on domain name registration in Indonesia, including requesting an invalidation of local domain names similar to well-known trademarks at the Indonesian domain name registry.
  • Advising on IP licensing, confidentiality and know-how transfer issues in connection with licenses and technology transfer agreements, distribution agreements and advising on broad issues concerning promotion and advertising. 
  • Advising on data privacy, internet regulatory and online content issues. 
  • Advising on transactional matters involving the acquisition of a trademark and patent portfolio, as well as cross-border technology licensing. 
  • Advising on relevant legal issues regarding intellectual property in the pharmaceutical industry (labelling, trademark issue on product packaging), advising on second medical use of patents.
