Ian Innes
Biography
Ian is a partner in the Brisbane office. He is a highly experienced insolvency, litigation and dispute resolution lawyer, having acted for a broad range of organisations in both the private and public sectors within Australia and internationally. Ian also has extensive experience gained across a range of industries in an insolvency context for financial institutions, insolvency practitioners and creditors.
Practice Focus
Ian acts for unsecured and secured creditors, insolvency appointees and debtors, in contentious and non-contentious insolvency work, including complex administrations and receiverships in a number of industries. He has wide experience in dispute resolution and litigation across a broad range of organisations in both the public and private sectors within Australia and overseas. Ian has acted in courts in jurisdictions in Australia, and has instructed on various matters outside the country. His recent experience includes acting in energy and resources disputes, administrative law litigation including challenges to major project approvals, and asset recovery work in international jurisdictions.
Representative Legal Matters
- Acted for the administrators of Network Ten in its successful restructure and acquisition by CBS
- Advised the mezzanine debt holders of Wiggins Island Coal Export Terminal (WICET) in the restructure of their debt, including a successfully implemented scheme of arrangement
- Advised and developed a Deed of Company Arrangement for China Railway Construction Group Co. Ltd in respect of the collapse of its Australian joint venture in residential construction, and successfully defended a court challenge to that DOCA
- Advised the administrators of the Arrium group in environmental and insolvency risks in respect of Queensland assets
- Advised a major international corporation in negotiations to assist its financially distressed joint venture partner, enabling all parties to complete the development of several Australian wind farms
- Acted for the administrators of Max Brenner in defending a contested application to terminate that administration
- Advised an international supplier of equipment to solar farms in relation to its exposures flowing from the RCR Tomlinson collapse
- Acted for the administrators/liquidators of iPipe Services Australia in extensive litigation under the Queensland subcontractors' charges regime
