Biography

Melanie Ho is a partner in Baker McKenzie’s Taipei office and is a key member of the EMI practice group.

Practice Focus

Melanie has substantial experience in handling complex energy projects, government procurement projects, EPC contracts, real estate development and insurance claims, as well as dispute related work on major infrastructure projects, with extensive experience in advising IPP clients and Taipower's contractors in power projects. 

Representative Legal Matters

Power

  • Xidao and Changfang offshore windfarm projects: Acting for the sponsor/developer CIP in relation to the establishment, development and various contracts of windfarm project.
  • Acting for foreign sponsors/developers on the development of the demonstration project of offshore windfarm projects, and offshore windfarm projects.
  • Advising several sponsors/developers on the development, EPC and O&M contracts of solar power projects in Taiwan.
  • Advising several renewable energy developers on the development of renewable energy projects in Taiwan.
  • Advising European wind turbine generator manufacturer on regulatory issues and contracts relating to operation and product supply in Taiwan.

Oil and Gas

  • Northern LNG Receiving Terminal Project: Acting as the general legal counsel for the state-owned petroleum corporation in the project in various government procurement law issues and project contracts (e.g. EPC contracts, PM contract, harbor contract, undersea piping contract, onshore piping construction contracts, LNG Supply and Purchase Agreement and shipping contracts); Representing on various disputes raised by contractors in mediation and litigation proceeding. 
  • The Third LNG Receiving Terminal Project: advising on terminal EPC contract, piping EPC contract, harbor EPC contract, and contract negotiation; Representing on disputes resolution.
  • Liquefied Natural Gas Supply and Purchase Agreement: Representing the purchaser to negotiate a long-term (25-year) contract with a Middle East state-owned gas corporation.

Transportation

  • Taiwan High Speed Rail System: Representing THSR for claims in arbitration proceeding.
  • Taoyuan International Airport Access MRT System Project: Acting as the general legal counsel for the awarded contractor of the Engineering and Maintenance (E&M) system of the project and advising the client in relation to various procurement law issues, system contracts, project consultant contracts and subcontracting issues.
