Biography

Daniel is a Local Principal with the Dispute Resolution Practice Group in Singapore. He is accredited by the Singapore Academy of Law as an Accredited Specialist in Building and Construction Law, and is currently a Council Member of the Society of Construction Law (Singapore).

He has more than 13 years of experience in this industry, having worked as an engineer and project manager handling overhaul and maintenance projects for the Republic of Singapore Navy’s submarines prior to practising law.

Practice Focus

Daniel focuses on the law relating to construction, engineering and technology projects (e.g., building, infrastructure, renovation/fit out, manufacturing, turn key, transportation, supply chain, energy, oil and gas projects etc.), for which he supports his clients on the:

  • Drafting of the suite of contracts and related documentation (either bespoke or based on standard form construction contracts such as SIA, REDAS, PSSCOC, FIDIC, JCT, NEC etc.) as well as the reviewing of tender bids and negotiations to close out;
  • Handling of legal issues throughout the project (e.g., claims for outstanding payment, additional costs, losses and expenses, omissions, variations, delay and/or disruption issues such as extensions of time and prolongation costs, suspension, acceleration, inspection and quality assurance, defects, insurance, indemnities, termination, SOP Act payment claim / payment response / adjudication procedures, final account closure, general business law queries etc.); and
  • Resolution of their disagreements with their contractual counterparties if there are any disputes that arise (e.g., through arbitration, litigation, adjudication or other alternative means of dispute resolution such as negotiations, mediation, expert determination or neutral evaluation).

Representative Legal Matters

International and Domestic Arbitration

  • Represented a Cambodian project company and key individuals in respect of claims by and counter claims against its contractor in an SIAC arbitration arising out of the construction of a major landmark development in Cambodia.

  • Represented a French international manufacturing company in claims against its employer in an ICADR arbitration arising out of the construction of a railway infrastructure project in India.

  • Represented an Italian international construction company in respect of claims against its employer in an SIAC arbitration arising out of the construction of a public project in Nepal.

  • Represented a Korean international construction main contractor in defending claims by its electrical contractor in an ICC arbitration arising out of the construction of a major mixed development in Singapore.

  • Represented a Laotian project company in respect of claims against its employer in an arbitration under the UNCITRAL Rules administered by the SIAC arising out of the development, ownership and operation of a power project in Laos.

Litigation

  • Represented a German international manufacturing and electronics company in the Singapore Court of Appeal and Singapore High Court in defending claims arising out of the fabrication of various structural components for an offshore oil & gas project in Indonesia.

  • Represented a US-based technology company in the Singapore Court of Appeal and Singapore High Court in resisting an application to set aside an arbitral award.

Adjudication under the Singapore Building and Construction Industry Security of Payment Act)

  • Represented a UK based international technology equipment manufacturer in defending claims by its consultant arising out of the construction of a facility in Singapore.

Transactions

  • Advised a Korean multinational construction company on the drafting of its Engineering, Procurement and Construction (EPC) turnkey contract in relation to the construction of a combined cycle gas fired electrical generation facility in Dominican Republic.

  • Advised a Singapore based private fund on the drafting of the suite of contractual documentation (including the project development management agreement, building contracts for the substation and for the main building based on the FIDIC Conditions of Contract) in relation to the development of a data centre in Taiwan.
