
Marc Cucarella
Biography
Marc Cucarella is a partner in the Employment and Compensation Practice in Barcelona and practices in the areas of labor and employment law. He is a regular lecturer at the ESADE law school and lectures on a variety of employment topics at other institutions and business and industrial associations (Fedequim, Barcelona Bar Association, Luxe Talent, etc.).
Marc has authored and co-authored various publications and articles on employment law, and he is a regular speaker at conferences and seminars on employment-related issues (Barcelona Bar Association, sector industries, etc.).
He also actively leads various Baker McKenzie publications, submissions and alerts from the Barcelona office and the Spanish offices.
Practice Focus
Marc advises domestic and multinational companies on a broad range of labor and employment matters, including the implementation of restructuring projects (collective and individual), negotiations with unions and work councils on a range of issues including collective layoffs and relocations, and collective bargaining agreements.
He also has extensive experience in the design and implementation of employment relationships (whether ordinary or of a special nature), remuneration policies (stock option and various bonus plans), due diligence processes and employment-related aspects arising from post-acquisitions and other restructurings. He also focuses on litigation and represents clients before courts and administrative bodies (mediation authorities, Labor Inspectorate, etc.) and in negotiations with work councils and unions.
Marc regularly intervenes in labor audits in the context of mergers and acquisitions projects and actively participates in the preparation of codes of conduct and various policies, being a member of the multidisciplinary work team in the compliance and ESG areas.
Representative Legal Matters

Advised a multinational pharmaceutical company on its acquisition by a fund, including the headquarters in Spain and the different subsidiaries in 12 countries, leading all the acquisition and post-acquisition matters to ensure a smooth integration.

Advised a multiservice company on the closure of different workplaces in Barcelona, which affected over 700 employees and involved substantial negotiations with trade unions and labor authorities in a highly conflicting environment.

Advised a group of companies in the technology sector on the restructuring of the group, including the liquidation and merger of different entities and the negotiations with the trade unions and work councils involved on the potential modification of conditions, including the representation in court of the companies in a collective litigation.

Advised a major multinational company in the retail sector on the implementation of a collective redundancy process to shut down a significant number of stores and the redundancy of around 150 employees, including actively participating in the negotiations and the implementation of the terminations.
