Biography

Caroline Bergsma is an associate in Baker McKenzie's Employment & Compensation Practice Group in Los Angeles. She advises major US and other multinational companies on a broad range of employment litigation and counseling matters. She also serves on the Firm's California Associates Committee and Recruiting Committee. Prior to joining the Firm, Caroline served as a judicial law clerk for the Honorable John. N. Nguyen.

Practice Focus

Caroline's practice focuses on advising employers on various employment matters, including recruiting, hiring, background checks, wage and hour compliance, employee classification, leaves of absence, requests for accommodation, handling of confidential and proprietary information, restrictive covenants, performance management, effectuating cost-cutting strategies, terminations, employment policies and handbooks, bonus and commission plans, and executive agreements. She also advises on domestic and international transactional matters, including employment due diligence for mergers and acquisitions, employee transfers, and post-transaction integration steps. She has extensive experience representing employers in state and federal trial courts and before administrative agencies involving claims of discrimination, harassment, retaliation, wrongful termination, failure to accommodate a disability, and wage and hour class and representative actions.

Representative Legal Matters

  • Advised McDonald's on its acquisition of Apprente, an artificial intelligence voice technology company based in Silicon Valley.

  • Advised on the spin-off and sale of a business unit of a publicly-traded multinational corporation involving 9 countries, with an announced deal value of USD 530 million.

  • Obtained summary judgment in favor of clients in cases involving disability discrimination, retaliation, wrongful termination, failure to accommodate, and violation of the FMLA/CFRA.
