Biography

Dr. Lukas Beiglböck is an associate in and member of the Healthcare & Life Sciences and International Commercial & Trade departments in Baker McKenzie’s Vienna office. He joined the Firm in September 2019 and supported the Firm as a trainee in the mentioned fields during his studies in Vienna. Lukas regularly publishes in relevant journals in the Healthcare & Life Sciences sector.

The Healthcare & Life Sciences practice focuses on key industries, such as medicinal products (drugs/medicines), medical devices & IVDs, biotechnology, biocidal products, or cosmetics and nutrition. International Commercial & Trade

The Commercial & Trade practice focuses on the international sourcing, manufacturing, distributing and selling of products and services, in particular via agency and brokerage models, or by way of distributors, such as authorized dealers or franchise systems. In practice, a crucial aspect are post-termination claims such as indemnities and investment compensations that may have overriding mandatory effect.

Correspondingly, the practice advises on trade compliance related issues such as anti-bribery and corruption, trade sanctions and export and import controls, as well as product labelling, product liability and safety (recalls and preventive measure), and sales promotion and marketing rules across multiple countries.

Another crucial regulatory aspect for engaging in commercial activities are business licenses and permits, such as obtaining the applicable trade licenses and facility permits, and appointing the required regulatory personnel.

In addition, the review and drafting of consumer contracts as well as advising in the course of class actions lodged by consumer associations (e.g., VKI) play an important role.

Representative Legal Matters

  • Provided commercial and regulatory advice to Lindsay on its investment in Pessl Instruments.
  • Advised the Kudelski Group on the commercial aspects on the sale of SKIDATA.
  • Advised an international telecommunication company on licensing requirements concerning supplying IT services and products to customers in Austria with regard to different distribution scenarios.
  • Advised an international company in the course of a M&A transaction with regard to post-transactional matters in the regulatory area such as toxins authorizations and radiation device registrations.
  • Advised a pharma company on regulatory matters such as licences and permits or regulatory personnel as well as on several aspects of GDP inspection.
  • Advised an international player in the beverage industry on special labeling requirements in Austria under the Austrian Waste Management Act (AWG).
  • Advised an international manufacturer in the cosmetics area on an administrative procedure against a distributor of its products.
  • Advised an international medical devices company on legal compliance of marketing materials and marketing measures.
  • Advising a large number of national and international companies on public law issues, in particular on all questions of Austrian trade law including cross-border service providing constellations.
