In a recent article for IAPP, Brian Hengesbaugh, Global Chair of Data and Cyber for Baker McKenzie, and Lukas Feiler, head of the Firm’s Commercial, Data, IPTech and Trade practice in Vienna, discuss how recent actions by the Trump administration could impact the EU-US Data Privacy Framework (DPF). 

While none of the administration's moves have directly affected the core US elements underpinning the DPF, there are concerns that these and/or future actions might lead to a Court of Justice of the European Union (CJEU) finding that could invalidate the European Commission's DPF adequacy decision.

They note that the DPF is crucial for US companies receiving personal data from European customers, as it helps them perform transfer impact assessments to evaluate privacy risks related to US government surveillance. Continued collaboration between the US and the EU is essential to ensure high privacy protection standards and provide certainty for companies engaged in trans-Atlantic business transactions.
