Global events in recent times have resulted in employers seeking ways to optimize their human resources, including developing leaner and more efficient workforces to pilot these uncertain times. In this session we explored the legal issues surrounding non-traditional forms of workforce engagement.

In particular, we discussed the following topics for Malaysia, Singapore, Indonesia and Vietnam:

  2. The status of contingent workers.
  3. The consequences of employee misclassification.
 

Session 2: The Legal Landmine of Workforce Optimisation

In today’s environment there is increased pressure on companies to operate leanly. For most, this means assessing their operations and if necessary, restructuring their workforce. What must an employer consider in these circumstances?

In this session of our workshop series, we explore the legal issues surrounding workforce optimization. In particular, some of the topics for Indonesia, Malaysia, Philippines and Thailand include:

  1. Workforce reduction
    • What are the jurisdictional requirements for redundancy?
    • Is a consultation process required?
    • What alternatives can an employer consider?
       
  2. Changing employee entitlements
    • How can this be implemented in practice?
    • Is consent required?
