Marcin Fiałka
Profil
Marcin Fiałka is a senior associate in the IP Tech group at Baker McKenzie’s office in Warsaw. He has over eight years of experience and specializes in data privacy, new technology and life sciences law. Marcin graduated from the University of Warsaw, Faculty of Law and Administration. In 2018 he was admitted to the District Chamber of Legal Advisors in Warsaw.
Pratiques
Marcin focuses on legal advisory concerning data privacy, technology and healthcare regulations. Since 2017 he has been a member of our GDPR task force involved in preparing and reviewing data protection documentation, including, inter alia, privacy policies and notices, data processing and transfer agreements, as well as compliance procedures and policies. Currently, Marcin is advising clients on a wide range of data privacy and security issues, including with respect to investigating and reporting of data security incidents. His expertise also includes direct marketing and e-commerce regulations.
Marcin has also been involved in several international projects for clients from technology, food & beverage and healthcare sectors, with particular emphasis on regulatory aspects. He has been also advising on a variety of pharmaceutical market regulations, as well as issues related to medical devices and food supplements.

Supported a multinational construction and development company in the area of maintaining the GDPR compliance of their operations in Poland, including a wide range of privacy-related matters, in particular concerning employees privacy, international data transfers and privacy implications of implementing new IT solutions.

Advised a client on the re-design of consumer touch-points, which was aimed at ensuring full GDPR compliance and uniformity thereof.

Advised a global pharmaceutical company on the local regulatory aspects of its acquisition of an oncology business from a competitor.

Advised a commercial organization in Poland on the EU law conformity of its counter-proposal to the governmental idea to introduce the Reimbursement Development Scheme to the Polish reimbursement system.

Advised a client on the structure of an innovative cooperation model with another global pharmaceutical company with respect to the distribution of a medicinal product.

Advised an innovative pharmaceutical company on local aspects concerning the global acquisition of a leading biotech company.
