Biography

Simone Rieken is a partner in Baker McKenzie's Frankfurt office and a member of the Information Technology Practice Group. Simone advises on all aspects of IT and data protection law, including IT contracts, the processing of personal data, other data related laws, the use of artificial intelligence and e-commerce. Prior to joining the Firm, she worked for a large German corporate law firm, also focusing on IT and data protection law. She was seconded to a major management consulting, technology and outsourcing services provider.

Practice Focus

Simone focuses her practice on advice in connection with IT outsourcing and IT transactions, including the drafting and negotiation of complex IT contracts. She also frequently advises on IT-related tenders at the interface with public procurement law. Another focus of her practice is on the analysis of IT and data driven business models and compliance with new IT and data related laws and regulations.

  • Advised companies from various industries on the application of the EU Data Act to their products and services and the implementation of the new regulatory requirements in their offerings and contract templates.
  • Advised a global IT services provider in connection with public tenders, including under the new EVB IT Cloud.
  • Advised a cloud provider on complex data protection law issues when providing cloud services in regulated industries.
  • Advised a software provider on the conclusion of a strategically important outsourcing agreement with a German asset manager.
  • Advised the prime contractor of a telecommunication services provider in a landmark project involving new technology.
  • Advised a wholesale company on the group-internal restructuring of IT services and the conclusion of a complex outsourcing agreement with a strategic partner.
  • Advised a company on a complex intra-group contractual framework for the procurement of IT services.
  • Advised in connection with RfPs for IT projects outsourcing, and agile software developments.
  • Advised various companies on data protection law and contractual questions in connection with customer loyalty programs.
  • Advised on data protection concerning the implementation of a data management platform and related website tracking and profiling.
  • Advised concerning direct marketing campaigns pursuant to data protection and unfair competition law, including the drafting of related consents.
  • Advised with regard to mobile applications and online shops pursuant to data protection and e-commerce law.
  • Advised globally operating clients from various industries on the implementation of the GDPR, including the drafting of notices, contracts and declarations of consent.
