Biography

Andi is a Senior Partner and the Head of Dispute Resolution, Antitrust & Competition at HHP Law Firm. With more than 20 years of experience, he has in-depth experience in arbitration (domestic and international), litigation (including employment litigation), debt recovery (PKPU restructuring & insolvency), compliance & investigation, corporate crimes, insurance disputes, cybersecurity, administrative and judicial review proceedings.

Andi is a registered arbitrator at Badan Arbitrase Nasional Indonesia (BANI), Singapore International Arbitration Centre (SIAC) and Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS-SJK).

He is a co-chairman of the Arbitration and Alternative Dispute Resolution Commission of ICC Indonesia and also a member of the International Insolvency Institute (III).

Representative Legal Matters

Represented an Asia-based conglomerate in various disputes concerning the hostile takeover of a joint venture company in Indonesia. The dispute involved arbitration proceedings (SIAC), multiple court litigations and criminal proceedings in Indonesia.
Represented numerous principals in disputes concerning termination of distribution agreements. The disputes involved arbitration proceedings, court litigations and criminal proceedings in Indonesia as well as regulatory issues involving BPOM (National Agency of Drug and Food Control), the Ministry of Health, the Ministry of Industry and the Ministry of Trade.
Represented numerous clients in managing shareholder disputes with local joint venture partners, including issues such as board disputes, minority oppression, good governance, exit strategy, arbitration cases on shareholders/joint venture agreements, court litigations and criminal cases.
Represented various financial institutions and creditors in court proceedings to obtain bankruptcy/PKPU court orders against their debtors at the Jakarta, Surabaya, Medan and Makassar Commercial Courts.
Represented a major shipping company listed in Jakarta and Singapore as a debtor in an approximately USD 2 billion PKPU/court-sanctioned debt restructuring process. The restructuring is multijurisdictional involving Indonesia, Korea, Singapore and US proceedings.
Advised an Asia-based investment group in debt recovery proceedings, including a road-map strategy to enforce the collateral (land mortgage, fiducia over inventories and receivables, personal and corporate guarantees).
Represented an international construction company in domestic arbitration against an Indonesian state-owned company in respect of dredging and reclamation work of a seaport in Makassar.
Represented numerous insurance companies regarding disputes on Property All Risk, Directors & Officers Liability and Public Liability Insurance policies. The disputes involved arbitration proceedings, enforcement of arbitration award, police investigation and regulatory scrutiny by OJK.
Represented numerous companies in antitrust proceedings ranging from abuse of dominance, cross-ownership, preferential treatment and distribution.
Represented numerous companies in parallel class action lawsuits concerning excessive tariffs in Indonesian courts.
Represented an Australian mining company in a judicial review against a Minister of Forestry Decree on Batang Gadis National Park.
